Information on the processing of personal data by OPTeam S.A. (General Data Protection Regulation)

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the so-called GDPR, in connection with contractual relationships, OPTeam S.A. provides information required for the processing of personal data.

1. Who is the personal data controller at OPTeam S.A.?

OPTeam S.A. with its registered office in Tajęcina 113, 36-002 Jasionka.

2. What personal data, for what purposes and on what legal basis does OPTeam S.A. process?

What personal data, for what purposes and on what legal basis does OPTeam S.A. process:

  • contacting you in response to an inquiry sent via the contact form (in which case the basis for processing is legitimate interest),
    selling OPTeam S.A. products and services and implementing contracts in this regard (in which case the basis for processing is the performance of a contract to which the data subject is a party, or to take action at the request of the data subject before concluding a contract),
    direct marketing of OPTeam S.A. products and services provided electronically (in which case the basis for processing is consent).

3. How long do we store personal data?

Until the inquiry submitted via the contact form is processed, and in the case of a sales transaction - until the expiry of the obligation to store data resulting from legal provisions, including the obligation to store accounting documents relating to contracts concluded with OPTeam S.A. In the case of direct marketing, personal data are stored until consent is withdrawn.

4. To whom and why OPTeam may transfer personal data?

Personal data may be shared by the Company with suppliers, partners, couriers, and transport companies solely for the purpose of fulfilling the contract/order. Data may also be transferred to institutions providing project funding (only if such funding is provided) and to public institutions in the event of an audit. Personal data may be transferred outside the European Economic Area based on appropriate legal safeguards, such as contractual clauses protecting personal data.

5. What rights does the Customer have regarding the protection of personal data?

The Client has the right to:

  • access, rectify, and delete their data from our resources,
  • restrict processing, obtain a copy of the data,
  • object to data processing,
  • withdraw consent (if granted), provided that actions taken before its withdrawal remain valid,
  • transfer personal data. If the data is processed based on consent or a contract, we will then transfer the data (if processed) on a secure medium,
  • file a complaint regarding data processing with the supervisory authority, i.e., the Personal Data Protection Office.

6. Information on the obligation or voluntary provision of data.

OPTeam S.A. hereby informs that the provision of data by our Clients and Contractors is voluntary for the purpose of contacting us in response to an inquiry submitted via the contact form or concluding an agreement with OPTeam S.A. We emphasize, however, that failure to provide data will prevent contact or the conclusion of an agreement. Providing data for marketing purposes is also voluntary, but failure to provide it will prevent us from sending marketing offers electronically or by telephone.

7. Profiling.

Personal data will not be subject to profiling.
